Collecting Personal Information

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support or subscribe to our emails. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. Device information

  • Purpose of collection: to load the Site accurately for you, and to perform analytics on Site usage to improve our Site.
  • Source of collection: collected automatically when you access our Site using cookies, log files, web beacons, tags or pixels.
  • Disclosure for a business purpose: shared with our processor Shopify.

Order information

  • Examples of Personal Information collected: name, billing address, shipping address, payment information (including card numbers), email address and phone number.
  • Purpose of collection: to provide products or services to you to fulfil our contract, to process your payment information, arrange delivery, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and, in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: shared with our processor Shopify.

Email marketing information

  • Examples of Personal Information collected: email address, first name, your email subscription status and when it changed, how you signed up (for example, which sign-up form you used), your order history, and which of our emails you open and which links you click.
  • Purpose of collection: to send you our marketing emails, to include your personal welcome discount code, to make our emails relevant, and to measure and improve them.
  • Source of collection: collected from you when you subscribe or buy from us, and automatically when you open our emails or click their links.
  • Disclosure for a business purpose: shared with our processor Shopify, whose Shopify Messaging service sends our emails.

Customer support information

  • Purpose of collection: to provide customer support.
  • Source of collection: collected from you.

The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfil our contracts with you, as described above. For example:

  • Our online store is hosted by Shopify. Shopify processes your Personal Information when you visit and make purchases on our store, including to provide services based on your interactions with other merchants and with Shopify. Your information is shared with Shopify and with other third parties that may be located in other countries, in order to provide services to you, including services that use data from your interactions with other merchants and with Shopify. Behavioural Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. We only show you ads based on your activity on our Site, with other merchants and with Shopify if you consent through our cookie banner, and you can change or withdraw that consent at any time through the cookie preferences link on our Site. Email marketing

If you subscribe to our emails, or if you buy from us and do not opt out when we give you the chance, we send you marketing emails about hydroponics advice, our products, new stock and offers. We usually send no more than one newsletter a week, plus a short series of welcome emails when you first subscribe and occasional emails linked to what you do on our Site (for example, a reminder about a checkout you did not finish). When you subscribe through a form on our Site, we ask you to confirm your subscription by email before we start sending.

We send these emails with Shopify Messaging, part of our Shopify store. We may record some information on your customer record as short labels (“tags”), for example how you signed up or that we have sent you a welcome code.

You can unsubscribe at any time using the link at the bottom of every email, by replying to one of our emails, or by contacting us. We act on unsubscribe requests straight away and within 48 hours at most. We keep your email address on a suppression list after you unsubscribe so that we do not email you again by mistake.

Welcome discount codes

When you subscribe to our emails through a form on our Site and have not ordered from us before, we create a personal discount code for you. It can be used once, on your first order, and expires 30 days after you subscribe. We store the code on your customer record so that we can include it in your welcome emails.

How we measure our emails

Our marketing emails contain a small tracking image (a “pixel”) and links that record when they are used. When your email app loads the images in one of our emails, the pixel tells us that the email was opened, when it was opened, and basic technical information such as the type of device or email app. When you click a link, we record which link you clicked, and the link tells our Site that your visit came from that email (using standard “UTM” tags in the web address). This lets us see which emails are useful, attribute Site visits and orders to our emails, and look after our sending reputation so that our emails reach inboxes.

You can stop open tracking by turning off automatic image loading in your email app. Some email apps already limit it: Apple Mail Privacy Protection hides whether you opened an email, and Gmail loads images through its own servers so we cannot see your location or device. You can stop all email tracking by unsubscribing.

Using Personal Information

We use your Personal Information to provide our services to you, which includes: offering products for sale, processing payments, delivery and fulfilment of your order, and keeping you up to date on new products, services and offers.

Lawful basis

Under UK data protection law (the UK GDPR and the Data Protection Act 2018) and, if you are a resident of the European Economic Area (“EEA”), the EU General Data Protection Regulation (“GDPR”), we process your Personal Information under the following lawful bases:

  • Your consent, for example to receive our marketing emails when you subscribe, and for non-essential cookies;
  • The performance of the contract between you and us, for example to process and deliver your order;
  • Compliance with our legal obligations, for example tax and accounting records;
  • To protect your vital interests;
  • To perform a task carried out in the public interest;
  • For our legitimate interests, which do not override your fundamental rights and freedoms, for example preventing fraud, telling existing customers about similar products (you can opt out at any time), and measuring and improving our Site and emails.

Retention

When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information, subject to the records we must keep by law. We keep your email marketing details for as long as you are subscribed; after you unsubscribe, we keep only your email address and the fact that you unsubscribed, so that we respect your choice. Email open and click records are kept with your customer record for as long as we keep that record. For more information on your right of erasure, please see the ‘Your rights’ section below.

Automatic decision-making

If you are a resident of the UK or the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

Your rights

If you are a resident of the UK or the EEA, you have the right to:

  • ask for a copy of the Personal Information we hold about you;
  • ask us to correct information that is wrong or incomplete;
  • ask us to erase your information;
  • ask us to restrict how we use your information;
  • object to how we use your information, including an absolute right to object to direct marketing at any time;
  • ask for your information in a portable format;
  • withdraw your consent at any time, where we rely on consent.

International transfers

Your Personal Information will be initially processed in Ireland and then will be transferred outside the UK and Europe for storage and further processing, including to Canada and the United States. Where your information leaves the UK, it is protected by the safeguards described in Shopify's privacy policy, such as adequacy regulations and standard data protection clauses.

A cookie is a small amount of information that’s downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies.
